1. Acceptance of Terms

Welcome to All Pro Cleaning Services LLC ("Company," "we," "our," or "us"). By accessing our website at getallproclean.com, scheduling a cleaning service, or using any of our services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our website or services.

These Terms constitute a legally binding agreement between you and All Pro Cleaning Services LLC. We reserve the right to modify these Terms at any time. Your continued use of our services after changes are posted constitutes your acceptance of the modified Terms.

2. Services Provided

All Pro Cleaning Services LLC provides professional cleaning services for residential, commercial, and specialty properties in Hutchinson, Kansas, and surrounding areas. Our services include but are not limited to:

• Residential deep cleaning and extreme cleaning
• Commercial and office cleaning
• Medical facility, school, government, and military cleaning
• Specialty services (carpet cleaning, window cleaning, power washing, gutter cleaning, junk removal, vehicle/RV detailing)
• Construction cleanup and move-in/move-out cleaning
• Hoarder cleanup and biohazard remediation

The specific scope of services will be determined through consultation and agreed upon before work begins. We reserve the right to refuse service or discontinue service at any time for any reason.

3. Estimates and Pricing

Estimates provided through our website calculator, phone, or email are approximate and based on the information you provide. Final pricing may vary based on:

• Actual property condition and cleanliness level
• Accessibility and layout of the property
• Specific requirements or special requests
• Additional services requested on-site
• Travel distance (properties more than 30 miles from Hutchinson may incur a travel fee of $0.50/mile each way)

A free on-site assessment can be provided for accurate pricing. All pricing is subject to change without notice. We will inform you of any price adjustments before beginning work.

4. Payment Terms

4.1 Payment Methods

We accept payment by cash, check, credit card, and debit card. Payment is due upon completion of services unless otherwise agreed upon in writing.

4.2 Late Payment

Invoices not paid within 30 days of the service date may be subject to a late fee of 1.5% per month (18% annual percentage rate) or the maximum rate permitted by law, whichever is less.

4.3 Deposits

For large projects or first-time customers, we may require a deposit of up to 50% of the estimated total cost. Deposits are non-refundable unless we cancel the service.

5. Scheduling and Cancellation

5.1 Scheduling

Services are scheduled based on availability. We will make reasonable efforts to accommodate your preferred date and time. Scheduled appointments are confirmed via phone or email.

5.2 Cancellation by Customer

If you need to cancel or reschedule, please provide at least 24 hours' notice. Cancellations made with less than 24 hours' notice may be subject to a cancellation fee of up to 50% of the estimated service cost.

5.3 Cancellation by Company

We reserve the right to cancel or reschedule services due to weather, equipment failure, staff illness, or other unforeseen circumstances. We will provide as much notice as possible and work with you to reschedule at no additional cost.

6. Property Access and Preparation

6.1 Access Requirements

You are responsible for providing safe and unobstructed access to all areas to be cleaned. This includes:

• Providing keys, access codes, or being present to grant entry
• Ensuring pets are secured in a safe area away from work zones
• Clearing clutter and personal items from surfaces to be cleaned
• Notifying us of any hazards, fragile items, or special considerations

6.2 Failure to Provide Access

If we are unable to access the property at the scheduled time due to circumstances within your control, you may be charged a trip fee of up to $75.

6.3 Valuables and Personal Items

We recommend securing all valuables, jewelry, cash, important documents, and fragile items before our arrival. While we take every precaution, we are not responsible for loss or damage to unsecured valuables.

7. Liability and Insurance

7.1 Insurance Coverage

All Pro Cleaning Services LLC carries general liability insurance and workers' compensation insurance. We are licensed, bonded, and insured to protect both our customers and our employees.

7.2 Limitation of Liability

Our liability for any claim arising from our services is limited to the amount paid for the specific service that gave rise to the claim. We are not liable for:

• Pre-existing damage or defects not caused by our services
• Damage resulting from improper use or maintenance of the property
• Loss or damage to unsecured valuables or personal items
• Indirect, incidental, consequential, or punitive damages
• Damage caused by hidden defects or conditions not visible during normal cleaning

7.3 Damage Claims

If you believe damage has occurred as a result of our services, you must notify us in writing within 24 hours of service completion. We will investigate the claim and, if our fault is established, will repair or compensate for the damage up to the limits of our insurance coverage.

8. Quality Guarantee

We stand behind the quality of our work. If you are not satisfied with any aspect of our service, please contact us within 24 hours of service completion. We will return to address any issues at no additional charge, provided:

• The issue is reported within 24 hours
• The property has not been cleaned or altered since our service
• The issue is within the scope of the original service agreement

This guarantee does not apply to services performed at the customer's specific request against our professional recommendation.

9. Health and Safety

9.1 Hazardous Conditions

We reserve the right to refuse service or discontinue work if we encounter hazardous conditions, including but not limited to:

• Mold, asbestos, or other environmental hazards requiring specialized remediation
• Biohazards (blood, bodily fluids, animal waste) beyond the scope of standard cleaning
• Structural damage or unsafe conditions
• Aggressive or uncontrolled pets
• Illegal substances or activities

9.2 Cleaning Products

We use professional-grade cleaning products that are effective and safe when used properly. If you have allergies, sensitivities, or preferences regarding cleaning products, please inform us in advance. We can accommodate most requests, though specialty products may incur additional costs.

10. Intellectual Property

All content on our website, including text, graphics, logos, images, and software, is the property of All Pro Cleaning Services LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content without our express written permission.

11. Privacy

12. Dispute Resolution

12.1 Informal Resolution

If you have a dispute with us, please contact us first to attempt to resolve the matter informally. Most disputes can be resolved through direct communication.

12.2 Mediation and Arbitration

If we cannot resolve a dispute informally, you agree to first attempt resolution through mediation. If mediation is unsuccessful, any remaining disputes will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, rather than in court.

12.3 Class Action Waiver

You agree to resolve disputes with us only on an individual basis and not as part of any class, consolidated, or representative action.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Kansas, without regard to its conflict of law principles. Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the courts of Reno County, Kansas.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. The invalid or unenforceable provision will be modified to the minimum extent necessary to make it valid and enforceable.

15. Entire Agreement

These Terms, together with our Privacy Policy and any written service agreement, constitute the entire agreement between you and All Pro Cleaning Services LLC regarding our services and supersede all prior or contemporaneous communications and proposals.
